1. Agreement

By accessing or using The Love Of Texas (the "platform"), you agree to these Terms of Service. If you do not agree, please do not use the platform.

We may update these terms from time to time. Continued use after an update means you accept the revised terms.

2. We are a platform, nothing more

The Love Of Texas is a discovery platform and directory. We publish listings so guests can find Texas businesses. We do not own, operate, staff, inspect, license, supervise, endorse, or control any business listed on the platform, and we are not a party to any transaction, reservation, booking, tour, service, sale, or visit that happens between a guest and a business.

Listings, ratings, photos, hours, prices, descriptions, and other details are supplied by businesses or gathered from public sources. They may be incomplete, outdated, or inaccurate. Always confirm important details directly with the business before you rely on them.

3. No responsibility for businesses or guests

The Love Of Texas is not responsible or liable for the acts, omissions, conduct, statements, pricing, availability, quality, safety, legality, licensing, hygiene, accessibility, or business practices of any listed business or any third party. Any dispute, injury, illness, property damage, financial loss, cancellation, refund, warranty, or service issue is strictly between you and that business.

We do not perform background checks, safety inspections, or license verification on listed businesses. Inclusion in the directory is not an endorsement, certification, recommendation, or guarantee of any kind.

4. Your responsibilities

Use the platform lawfully and respectfully. Do not submit false, misleading, defamatory, infringing, or unlawful content, scrape the platform, interfere with its operation, or attempt to gain unauthorized access.

You are solely responsible for your own decisions, travel, purchases, and safety, and for supervising anyone in your care.

5. Business listings

If you claim or submit a business, you confirm you are authorized to represent it and that everything you submit is accurate and lawful. You grant us a non-exclusive, royalty-free license to display your submitted content on the platform.

We may edit, decline, suspend, or remove any listing at our discretion, including for inaccuracy, complaints, or violations of these terms.

6. Disclaimer of warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation.

7. Limitation of liability

To the maximum extent permitted by law, The Love Of Texas and its owners and operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, data, goodwill, personal injury, or property damage, arising from or related to your use of the platform or any business found through it. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).

8. Indemnification and hold harmless

You agree to indemnify, defend, and hold harmless The Love Of Texas, its owners, operators, officers, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, injuries, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your dealings with any business or guest found through the platform, any content you submit, or your violation of these terms. This obligation survives your use of the platform.

9. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Texas.
